The Petition for Writ of Mandate is based on the excellent premise that Proposition 8 “is invalid because it would constitute a CONSTITUTIONAL REVISION, not a constitutional amendment, and AS SUCH, THE CALIFORNIA CONSTITUTION PROVIDES THAT IT MAY NOT BE ENACTED BY INITIATIVE.” The Petition does an excellent job of discussing the history of civil rights struggles and the necessity of California courts to exercise “their core, traditional constitutional role of protecting the established equality rights of a minority.” “If permitted to stand, Proposition 8 would strike directly at the foundational constitutional principle of equal protection in a manner that far transcends its immediate impact on a particular group, by establishing that an unpopular group may be selectively stripped of fundamental rights by a simple majority of voters.” “Such an attempt to mandate government discrimination against a vulnerable minority in our state’s Constitution, and to prevent the courts from fulfilling their quintessential constitutional role of protecting minorities, would work such a drastic change in our constitutional system that it must be regarded as a REVISION rather than an amendment.

Lambda & ACLU File Lawsuit to Toss Prop 8 : Indybay

A giant legal F You to all those who’re making California feel like the old South right about now.  :)  Told ya they won’t win!  The important thing to consider here is that the court already made their opinion on the matter clear when they ruled in favor of same sex marriages.  Taking this new case to them, having already proven that it’s discrimination, is stacking a lot of nice precedent in our favor.  

“Discrimination based on a suspect classification”  is both a strange and fantastic way to put it.

A black man was elected president in America last night

Some people don’t think it’s a big deal.  Those people might not realize that when their parents were their age, black people couldn’t drink out of the same fountain.  It’s a big deal.  So everyone calm down.  We can do this. Gavin will do what he did the first time. And we’ll get taken to court again, and they’ll vote in our favor again, and even if they don’t we’ll just pay a huge fine and go right back to doing it.  And we’ll repeat that cycle until people get hip to human rights.  It’s called civil disobedience, and it works.  So just relax, nothing is fucked here.  You’re all being very undude.  We got this.

I Dream of Equality

I’m hitting to bricks tonight, happy to soon be living in a new time; ashamed of my fellow Californians.  I will cross all appendages and wish all I’ve got that when I wake up Orange County will surprise the world, and that these other unreported numbers sway the way of human rights.  If this passes, our massive SF city wide “Welcome Back America” party will donate all $ to overturning Prop 8.
